Protecting your privacy is important to us. We hope the following statement will help you understand how we collect, use and safeguard the personal information you provide to us on our site.

I. What kind of information do we collect from you when you visit our site?

When you visit SophieJamesWine.com, our stats package from Google collects some basic information about your browser. Examples are things like what type of browser and operating system are you using; how long did you stay on our site; what pages did you look at. This helps us understand how visitors browse our site, so that we can make their shopping experience better.

We also collect personal information about you when you check out of our store such as your name, address, postal code, phone number, etc. We need this information to process payment and ship merchandise to you.

II. Sharing of personal information - we don't do it.

Under no circumstances will we share any personal information that we collect with any third parties or web sites. All the information you give us is completely private and used solely for order processing and shipping. If you give us permission to send you marketing emails then we use your email for that purpose, but never does that email get sold or distributed to any other web site or list.

III. Newsletter Opt-Out.

If you have chosen to opt into our newsletter or marketing emails and decide to opt out, we have a simple unsubscribe form that will let you get off our email list. Also, under the member area, you will find a simple form to unsubscribe.

IV. Consumer inquiries and privacy.

If you have any questions about your privacy, or want to make changes to your profile, or get off our marketing list, simply send us an email.

V. Protecting your information.

All the payment information we collect is done so under SSL - a standard internet security measure. Any data that we store about you is kept behind a secure firewall in our database and is not accessible to the public in any way.

Wine-Specific Conditions

Legal Requirements

You must be 21 years of age or older, to order or receive alcoholic beverages from Sophie James Wine Co. Receipt of shipments containing alcoholic beverages requires the signature of a sober adult (a person 21 years of age or older who is not intoxicated). Wines purchased from Sophie James Wine Co. are not for resale, and are for personal consumption only.

Credit Card Charges

Orders are by credit card only. We accept Visa, MasterCard, and American Express. 

Wine is a Delicate Commodity

Wine is a perishable commodity. Wine does not like extremes of temperature: hot humid summer and cold winter weather may adversely affect the condition of your wine during shipment. Sophie James Wine Co. is not responsible for, and will not replace wine that is damaged by extreme weather conditions during shipment. When your wine order is picked up by the common carrier for delivery, responsibility for the wine becomes the responsibility of the purchaser.

Returns & Cancellations

We will replace or refund you for any bottle of wine that is damaged, flawed or that the customer finds unsatisfactory. We ask the customer return the unfinished portion of the original bottle for replacement. By law, we cannot accept returns of alcoholic beverages unless the product is corked, or flawed. We are also unable to accept return of wine that was damaged due to adverse weather conditions during shipment, or wine that is ordered in error. Please send an email to (club@sophiejameswine.com) to arrange for the return of corked or flawed product.

Once the wine is received we will refund your credit card account for the cost of the wine less shipping and handling. If the original shipment was damaged or flawed you will receive a full refund, including shipping and handling charges. Please contact the tasting room at (club@sophiejameswine.com) for return instructions.


SOPHIE JAMES WINE LLC, TEXT MESSAGE PRIVACY NOTICE

This Text Message Privacy Notice describes the information Sophie James Wine LLC (collectively “Company”, “we”, “our”, or “us”) collects, how we use and retain this information, with whom we share it, and the choices you have in connection with our text messaging program (the “Platform”) as defined below in the United States. All information posted in the is intended for the U.S. market only.

1. SCOPE

When does this Privacy Notice apply?
This Privacy Policy applies to Sophie James Wine LLC’s collection personal information from you or about individuals using the Platform as well as when you provide personal information to us. The Platform includes any online forms associated with our text messaging program, when you subscribe to or interact with our text messaging program or click on hyperlinks in text messages provided through our text messaging program. 

When does this Privacy Notice not apply?
This Privacy Policy does not apply to any other processing of your personal information by Sophie James Wine LLC.   This Privacy Policy does not apply to websites or other domains that are maintained or operated by third parties or our affiliates. Our Platform may link to third-party websites and services, but these links are not endorsements of these sites, and this Policy does not extend to them. Because this Policy is not enforced on these third-party websites, we encourage you to read any posted privacy policy of the third-party website before using the service or site and providing any information.

2. PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, HOW LONG WE KEEP IT, AND HOW WE SHARE IT
When you interact with our Platform, we collect your personal information. “Personal information” is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.  We use the following criteria to determine whether it remains reasonably necessary to retain your personal information for one or more disclosed operational purpose, or a service provider or contractor’s operational purpose(s): (i) whether there is a retention period required by statute or regulations; (ii) the existence of actual or threatened litigation for which we are required to preserve the information; (iii) the statutes of limitations for potential legal claims; and (iv) generally accepted best practices in our industry, including related to safety and security of our properties and assets. When we determine that it is no longer reasonably necessary to retain your personal information for one or more disclosed operational purposes based on the above criteria, we will delete your Personal Information. 

A. Information you provide to us.
When you use the Platform, we collect Personal information from you when you: 

  • Register for the Platform. When you register for the Platform, we collect your identifiers (name, telephone number, email address, mailing address), sensitive personal information (real-time location, age/birthday), payment card information (such as card number, expiration date, security code and ZIP code)). We will use this information to set up your account, payment for your account (if applicable), and communicate with relative to the Platform. You will also be added to our email marketing list (see “Subscribe to our Emails” below).

  • Use the Platform. When you use the Platform, we collect your identifiers (first and last name, email address; telephone number), auditory and visual information (your appearance and the sound of your voice via live and pre-recorded video) and sensitive information (real-time location), comments or messages provided in free text boxes, and any other information you send through the Platform. We will only use this information to facilitate your use of the Platform. 

  • Request Information from us. When you request information from us, we will collect your identifiers (name, email address, telephone number), and the details of your request. We will only use this information to respond to your request.

  • Subscribe to our Emails. When you are added to our email marketing list, if we have not collected your identifiers already, we collect your personal identifiers (email address), and contact preference.  We use this personal information to send you email alerts with our company newsletter, and to communicate with you via email about our products and services. We will share your identifiers with our email marketing provider to send you the marketing emails. You can unsubscribe to marketing emails at any time by clicking on the “unsubscribe” link in each email. Please note that we will continue to send you notifications necessary to the services or requested products or services. 

  • Use the website chat functionality. When you use the website chat functionality, we will collect your name and any personal information you disclose in the chat. We will use this information to provide customer service and respond to your inquiries. We will share this information with our website chat provider to facilitate the use of the webchat functionality.

  • Subscribe to texts or interact with hyperlinks in text messages. When you subscribe to our text messages or interact with hyperlinks in our text messages we collect your device ID, IP address, phone number.. We use this personal information to fulfill your request to receive text messages and to communicate with you via text about promotional and informational content.

NOTE: When providing your personal information, please provide only relevant information and do not provide unnecessary sensitive information, such as Social Security numbers or other sensitive personal data. Additionally, we may ask you to create a username and password that should only be known to you.

B. Information collected automatically through the Platform.
In addition to the personal information you provide directly to us, we also collect information automatically as you use our Platform. We use essential, functional, analytics, and advertising cookies to collect your internet or other electronic network activity information (device, usage, location information (determined through your IP address), such as your browsing history, configuration, unique online identifiers, and interactions with our ads on third-party websites), when you interact with the Platform. We use this information to: (i) track you within the Platform; (ii) enhance user experience; (iii) conduct analytics to improve the Platform; (iv) prevent fraudulent use of the Platform; (v) diagnose and repair Platform errors, and, in cases of abuse, track and mitigate the abuse; and (vi) market to you more effectively across different web pages and social media platforms.

Of course, if you do not wish to have cookies on your devices, you may turn them off at any time by modifying your internet browser’s settings. However, by disabling cookies on your device, you may be prohibited from full use of the Platform’s features or lose access to some functionality. Also, disabling cookies will not stop certain other collection technologies (like HTML5 – see below).

  • Google Analytics. The Platform sends aggregated, non-Personal Information to Google Analytics for the purpose of providing us with the ability to conduct technical and statistical analysis on the Platform’s performance. For more information on how Google Analytics supports the Platform and uses information sent from the Platform, please review Google’s privacy policy available at https://policies.google.com/technologies/partner-sites.

  • Web Beacons. A Web Beacon is an electronic image. Web Beacons can track certain things from your computer and can report activity back to a web server allowing us to understand some of your behavior. If you choose to receive emails from us, we may use Web Beacons to track your reaction to our emails. We may also use them to track if you click on the links and at what time and date you do so. Some of the third-party marketers we engage with may use Web Beacons to track your interaction with online advertising banners on our Platform. This information is only collected in aggregate form and will not be linked to your Personal Information. Please note that any image file on a webpage can act as a Web Beacon.

  • Embedded Web Links. Links provided in our emails and, in some cases, on third-party websites may include tracking technology embedded in the link. The tracking is accomplished through a redirection system. The redirection system allows us to understand how the link is being used by email recipients. Some of these links will enable us to identify that you have personally clicked on the link and this may be attached to the Personal Information that we hold about you. This data is used to improve our service to you and to help us understand the performance of our marketing campaigns.

  • HTML5 and Local Storage. We and our third party providers may use HTML5 to store information locally on your computer or device about your Platform usage activities. This information can be written and retrieved by us and our providers to determine how our Platform is being used, to enable use of the Platform, to assess how our Platform may be improved, and to customize the Platform for you. Some internet browsers allow you to disable HTML5 local storage or delete information contained in HTML5 local storage using browser controls, but you may not be able to control, delete or disable such local storage depending upon your browser.

Third-party Websites and Services. We work with a number of service providers of marketing communications technology. These service providers may use various data collection methods to improve the performance of the marketing campaigns we are contracting them to provide. The information collected can be gathered on our Platform and also on the websites where our marketing communications are appearing. For example, we may collect data where our banner advertisements are displayed on third-party websites@.

3. HOW WE SHARE YOUR PERSONAL INFORMATION 
Under no circumstances will Sophie James Wine LLC sell or share your mobile phone number or other personal information with third-parties or affiliates for marketing or promotional purposes. 

A. General Sharing. Sophie James Wine LLC shares personal information in the following instances: 

  • Within Sophie James Wine LLC. We share your personal information within Sophie James Wine LLC for the legitimate business purposes of efficiently and effectively providing the Platform, such as customer service support. 

  • With service providers. We share personal information with service providers that assist us in providing the Platform. These service providers are described more specifically in the PERSONAL INFORMATION WE COLLECT, HOW WE USE IT, HOW LONG WE KEEP IT, AND HOW WE SHARE IT section of this Privacy Notice. 

  • In the event of a corporate reorganization. In the event that we enter into, or intend to enter into, a transaction that alters the structure of our business, such as a reorganization, merger, acquisition, sale, joint venture, assignment, consolidation, transfer, change of control, or other disposition of all or any portion of our business, assets or stock, we would share personal information with third parties, including the buyer or target (and their agents and advisors) for the purpose of facilitating and completing the transaction. We will also share personal information with third parties if we undergo bankruptcy or liquidation, in the course of such proceedings.

  • For legal purposes. We will share your personal information where we are legally required to do so, such as in response to court orders, law enforcement or legal process, including for national security purposes; to establish, protect, or exercise our legal rights, as required to enforce our terms of service or other contracts; to defend against legal claims or demands; to detect, investigate, prevent, or take action against illegal activities, fraud, or situations involving potential threats to the rights, property, or personal safety of any person; or to comply with the requirements of any applicable law.

  • With your consent. Apart from the reasons identified above, we may request your permission to share your personal information for a specific purpose. We will notify you and request consent before you provide the personal information or before the personal information you have already provided is shared for such purpose. You may revoke your consent at any time.

Apart from these forgoing purposes, for other use cases, text messaging originator opt-in data and consent will not be shared with any third parties. 

4. GENERAL INFORMATION CHOICES
You have the following choices with respect to your personal information. 

  • Text Messages and Calls. You can opt-out of receiving text messages or calls to your phone number at any time by (i) for text messages, texting “STOP” in response to any text message you receive from us or contacting us as set out in the “Contact Us” section below and specifying you want to opt-out of text messages; and (ii) for calls, requesting opt-out during any call you receive from us or contacting us as set out in the “Contact Us” section below and specifying you want to opt-out of calls.  For more information, please see the SMS Terms and Conditions.

  • Opt Out of Marketing Communications. All users may opt-out of receiving marketing emails and newsletters at any time by changing their preferences via logging into our website, emailing us directly to opt-out, or by using the opt-out link located at the bottom of our emails. Please note that we will continue to send you notifications necessary to the Platform, your account, purchases, or any assistance you request.

7. SECURITY OF YOUR PERSONAL INFORMATION 
We implement and maintain reasonable security measures to protect the personal information we collect and maintain from unauthorized access, destruction, use, modification, or disclosure. These security measures include secure server software and firewalls designed to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, no security measure or modality of data transmission over the Internet is 100% secure and we are unable to guarantee the absolute security of the personal information we have collected from you. 

8. AGE RESTRICTION
The Platform is not intended for individuals under the age of twenty-one (21) years old, and we do not knowingly collection personal information of persons under the age of twenty-one (21) years old. If we learn that we have collected or received personal information from a child under the age of twenty-one (21) years old, we will delete that information. 10. US MARKET ONLY
All information posted in the Platform is only intended for the U.S. market. If you are accessing the Platform from outside of the U.S., please be aware that information collected through the Platform may be transferred to, processed, stored, and used in the U.S. and other jurisdictions. Data protection laws in the U.S. and other jurisdictions may be different from those of your country of residence.

SOPHIE JAMES WINE LLC TEXT MESSAGING TERMS AND CONDITIONS

Effective: October 20, 2025

These Terms and Conditions (“Terms”) are a legal agreement between Sophie James Wine LLC (“company”, “we”, “us”, “our”) and you, which describes the terms and conditions applicable to your use of our SMS messaging program (the “Platform”). By registering for or using our Platform, you agree to abide by all of the terms and conditions of these Terms between you and us. You agree to use our Platform in accordance with these Terms of Use, our Privacy Policy, and any additional rules that may apply to specific functionality of our Platform.

The Platform
RedChirp operates the Platform that sends opted-in subscribers SMS messages to interact with RedChirp by text message.  Subscribers can also expect to receive periodic conversational, informational and promotional messages from RedChirp. 

You may have the opportunity to receive SMS or "text" messages, pre-recorded voice messages or auto-dialed phone calls from us, our affiliates, subsidiaries, and related entities. Such messaging may be used to authenticate your identity or mobile device, as well as provide you informational updates about services or products you may have requested. In providing your mobile device number or cell phone number to the Platform, you knowingly consent to such communications from the Platform or for the Platform to use your cell phone number or mobile device number in accordance with these Terms. In providing your number and accepting these Terms, you represent that you have the authority to agree to receive text messages at the telephone number that you provide to the Platform, or from which you sent the text message request to us. You further acknowledge that no purchase is required to opt into this service, and you may opt out at any time.

You can cancel the SMS service at any time. Just text "STOP" to the number or short code that sent you the message. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at info@sophiejameswine.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you.  Message frequency varies.  If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

In providing your mobile device number or cell phone number to the Platform, sending or receiving text messages via the Platform, you knowingly consent to SMS or "text" messages transmitted or received within the Platform being recorded and stored. You acknowledge that such messages are the data of Sophie James Wine LLC and will be viewable and processed by Sophie James Wine LLC and by RedChirp, LLC (“RedChirp”) (the provider of the Platform), and you knowingly consent to the same.

Content and User Submission
Except for public domain materials, all the contents (including, but not limited to, information graphics, pictures, descriptions, etc.) published on our Platform (“Content”) are protected by applicable intellectual property laws, and are owned by us, or the party credited as the provider of the Content. You must abide by all additional copyright notices, information, or restrictions contained in any Content accessed through our Platform.

Access and Availability of Service and Links
Our Platform may contain links to other related websites. You agree that we will not be liable for the availability of these outside resources or their content. By including links to external websites and information, such placement on the Platform does not constitute an endorsement, affiliation, approval, or any other affiliation or relationship with the third party content and website. You should direct any concerns regarding any external link to the customer service of such websites.

Registration and Security
If you register an account on our Platform, as part of the registration process, you may give us certain registration information, all of which must be accurate and updated. You may not: (i) select or use information of another person with the intent to impersonate that person; or (ii) use information in which another person has rights without such person’s authorization. Failure to comply with the foregoing shall constitute a breach of these Terms, which may result in immediate termination of your account.

You shall notify us of any known or suspected unauthorized use of your account, or any known or suspected breach of security, including loss, theft, or unauthorized disclosure of your information.

You are responsible for all usage or activity on your account, including use of the account by any third party authorized by you to use your user ID and password. Any fraudulent, abusive, or otherwise illegal activity may be grounds for termination of your account, at our sole discretion, and we may refer you to appropriate law enforcement agencies.

We reserve the right to gather and use information about your usage and agree to maintain your data privacy, in accordance with our Privacy Policy, which is incorporated herein.

We may contact you regarding your participation in user surveys, asking for feedback on our Platform and existing or prospective products and services. This information will be used to improve our Platform and our Apps and better understand our users.

Fees and Payments
We reserve the right at any time to charge fees for access to portions of our Platform or our Platform as a whole. However, in no event will you be charged for access to our Platform unless we obtain your prior agreement to pay such charges.

If at any time we require a fee for portions of our Platform that are now free, we will give you advance notice of such fees and the opportunity to cancel the account before such charges are imposed. You shall pay all fees and charges incurred through your account at the rates in effect for the billing period in which such fees and charges are incurred, including, but not limited to, charges for any products or services offered for sale through our Platform. All fees and charges shall be billed to and paid for by you. You shall pay all applicable taxes relating to use of our Platform through your account.

You expressly agree that our Platform shall not for any reason whatsoever be liable to refund the full amount or any part of fees, charges and taxes paid by you.

Representations and Warranties
You represent, warrant and agree that no materials of any kind submitted through your account to the Platform will (i) violate, plagiarize, or infringe upon the rights of any third party or (ii) contain libelous or otherwise unlawful material. 

Our Platform is available “as is.” We do not warrant that our Platform will be uninterrupted or error-free. We are not responsible for the availability, content or services of other third-party providers that may be linked to or posted within our Platform. While we intend to take reasonable steps to prevent the introduction of viruses, worms, or other destructive materials to our Platform, we do not guarantee that our Platform or materials that may be downloaded from our Platform do not contain such destructive features. We are not liable for any damages or harm attributable to such features. If you rely on our Platform and any materials available through our Platform, you do so solely at your own risk.

Indemnification
You hereby indemnify, defend and hold us and RedChirp harmless from and against any and all liability and costs incurred by us or RedChirp in connection with any claim arising out of any breach by you, or any user of your account, of these Terms, or related to the Platform or the Content. You shall cooperate as fully as reasonably required in the defense of any such claim.

Limitation and Liability
Under no circumstances shall we or RedChirp be liable for any indirect, incidental, special or consequential damages of any kind that result from the use of or the inability to use all or any part of our Platform even if we are advised beforehand of the possibility of such damages. You specifically acknowledge and agree that we are not liable for any defamatory, offensive or illegal conduct of any user. If you are dissatisfied with any material, products, or services on our Platform, or with any of our terms and conditions, your sole and exclusive remedy is to discontinue using our Platform.

Software Licenses
You shall have no rights to the proprietary software and related documentation, or any enhancements or modifications thereto, provided to you in order to access our Platform. You may not sublicense, assign, or transfer any licenses granted by us, and any attempt at such sublicense, assignment or transfer shall be null and void. You may make one copy of such software for archival purposes only. You may not otherwise copy, distribute, modify, reverse engineer, or create derivative works from such software.

Termination
We and RedChirp may terminate or cancel your access to our Platform at any time, with or without cause, with or without notice. In the event of such termination, any information you have stored on our Platform may not be retrieved later.

Changes to these Terms
Sophie James Wine LLC may revise these Terms or the Platform, or stop providing the Platform, at any time and without notice to you. Sophie James Wine LLC encourages you to review these Terms frequently (the date of the most recent revision to these Terms appears at the top of these Terms). Your continued access to or use of the Platform after such posting constitutes your consent to be bound by the Terms, as amended.

If we make any material changes to this Policy, we may also notify you either through the email address you have provided, or by placing a prominent notice on our website.

Governing Law
These Terms shall be governed by the laws of the State of California. You agree and hereby submit to the exclusive personal jurisdiction and venue of the state courts in Sonoma County, California, and the United States District Court for Northern District of California, with respect to such matters.

Survivability
If any provision of these Terms are held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.
